Terms of Service & End User License Agreement

Monterey Events

These Terms of Service and End User License Agreement ("Terms") are a legal agreement between you and Monterey Events ("we", "us", "our") governing your use of the Monterey Events iOS app and the Monterey Events website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Monterey Events app on Apple devices you own or control, for your own non-commercial use, subject to these Terms and to Apple's Licensed Application End User License Agreement. You may not copy, modify, reverse engineer, redistribute, sell, or sublicense the app or any part of the Service except as the law expressly permits.

3. User-generated content

The Service may let you submit content, including comments, RSVPs, event submissions, profile details, and other materials ("User Content"). You retain ownership of your User Content. By submitting it, you grant Monterey Events a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that User Content solely to operate, provide, and improve the Service. You are responsible for your User Content and represent that you have the rights to submit it and that it does not violate these Terms or any law.

4. Zero tolerance for objectionable content and abusive users

Monterey Events has zero tolerance for objectionable content and abusive users. There is no warning system and no second chance for content that targets, harasses, or endangers people. Content that violates this policy is removed and the responsible accounts are suspended or terminated.

You agree not to post, submit, or transmit User Content, and not to behave in any way, that:

Event listings, venue information, photos, and business content come from third parties, including businesses that use the Monterey Events business portal and publicly available sources. We do not guarantee that any listing is accurate, complete, current, or that an event will take place as described. Confirm details with the venue or organizer before you rely on them. Links to third-party sites and services are provided for convenience and are governed by their own terms.

If you own a photo, a description, or a listing that appears in the Service and you want it removed, see Copyright & Removals or email removals@monterey-events.com. We remove it on request — you do not need to file a formal notice first.

8. Termination

You may stop using the Service and delete your account at any time by emailing info@monterey-events.com. We may suspend or terminate your access to the Service, remove your User Content, or close your account at any time, with or without notice, if you violate these Terms, if we are required to by law, or to protect the Service or its users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) survive.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that event information is accurate.

10. Limitation of liability

To the fullest extent permitted by law, Monterey Events and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed one hundred US dollars (USD $100).

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Service after an update means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Monterey County, California have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction there.
